Probate Records of William McCoy, Williamson Co TN Dist 25 resident

I found mention of a William Cook which is likely my 2nd Great Grandfather, William C Cook in the Williamson County Minute Books, Vol 9,  page 173.  The case is that of Samuel B Robinson  admin & c vs Ann McCoy & als (sic) and begins at the bottom of page 172.  My access to the records was via the microfilmed books which were filmed by the TN State Library and Archives in 1966 in a 19 reel set and digitized by FamilySearch which has made them available at their website FamilySearch.org.   Volume 9 of the Williamson Co TN Minute books can be found FamilySearch on the reel which contains v. 9-11 1837-1845(Film # 008150669).   The image is 109 of 833.

Samuel B Robinson was appointed the administrator of Wm McCoy's estate.  Wm McCoy died in 1836(Estate Sale Records date is 28th Sept 1836) however he is listed in years 1836,1837, and 1838 on the Williamson Co TN Tax list. Usually it will say "heirs of" on a tax list but it may be because his estate wasn't yet settled.  His probate is recorded in Williamson Co TN Will Book 7 pg 530 on Ancestry.  It appears that Wm died with more debt than he had the ability to cover without selling land which he owned.  Samuel was advised that it can be best settled by selling the land McCoy owned as one large lot rather than individual lots and he is petitioning the court to ask them to let him do this so he can settle the estate.

Reasons I believe this is my William Clifford Cook
  • Two of William's brother-in-laws are listed among those who(like William) are owed money by William McCoy.
  • Samuel B Robinson & William McCoy were residents of District 25 of Williamson Co TN.  
  • District 25 is the area in which Wm C Cook is known to have lived 
  • Joseph S Cook(over whose estate Wm C Cook was appointed admin) also lived in District 25 and is somehow related to Wm C Cook though their exact relationship has not yet been proven. Jos. S. Cook's probate documents put Wm C Cook in Williamson Co TN in Oct 1838.
  • Jos S Cook and Wm C Cook are the only persons with the Cook surname that I have found within Dist 25 of Williamson Co TN during the time period covered.
  • There are 4 others listed who are also Williamson Co TN Dist 25 residents:  Jackson, Hill, Patterson, and Ransom.
The case records provide me with more information to add to my page about residents of Williamson Co TN Dist 25.  I hope to also locate the notice from the newspaper about the sale mention within the case record.  I was able to find some additional records on William McCoy.  Below is the information I was able to gather from reading the Williamson Co TN court minutes of 26th July 1838.

Be it remembered that this cause cam on to be again heard on the bill former order and report of the clerk which is in the words and figures following  The undersigned clerk & C to whom this cause stands referred by an interlocutory decree made  ___ at the present term of this civil reports that he has certain proof upon affidavit which is here with filed as to whether the land mentioned in the Pleadings? would sell for more in lots or whether it would sell for more or a better price if sold all together from which proof he is inclined to believe it would sell for a better price if sold all together as in one lot.  As to that part of said interlocutory decree which requires him to take an account with respect to the administration of the estate b the complainant as administrator aforesaid  he reports that he has on ???? the settlement of said administrator so  ? made with the  clerk of the county court of Williamson County in pursuance of an act of assembly in such case made and provided from which settlement it appears that there is due said administrator the sum of Twenty one dollars and ninety one cents

and that the personal estate is exhausted--and that there is still due and owing from said estate the following debts to wit:

amounting in total to $114.50(This total listed here is less than the one I arrived at when I did a total from this list.  I did double check the amount owed each person and believe I have all of those correct.  Not sure about his math but this appears to be what is written in the book)

and he further reports that from the best information and proof so to the probable value of land mentioned in the complainants bill that said land is worth from three to four dollars per acre all which is respectfully submitted   Jno W Allen From which being read & heard & not being excepted to is in all things confirmed and it appearing to the court that the personal estate of William McCoy dec'd has been exhausted by the administrating in the payment of bona fide debts of the --- --- estate pf said estate and that there still remain bona fide debts against said estate unpaid and it further appearing that it is necessary that the whole of said tract of land be sold for the purpose of paying said unpaid debts and that it is to the interest of the defendants & the creditors that the whole of said tract of land be sold in one lot.  It is therefore ordered adjudged and decreed by the court that the complainant Samuel B Robinson administrator as aforesaid sell the tract of land described in this bill at pulick sale to the highest bidder at Versailles in Williamson County giving forty days notice upon a credit of six and eighteen months and that he takes the bonds of the purchasers with two good freehold sureties for the payment of the purchase money and also ?  a lien on the land for the payment of the purchase money.  It is also ordered that the complainants advertise the time, place and terms of said sale in some publick news papers printed in the town of Franklin and that said Robinson make report to the next term of this court until when when(sic) all other matters are resolved??

Williamson Co. TN--Dist 25(1836-1840)--R-S

Over the past few years I've been studying Williamson Co TN Dist. 25 in hopes that knowing how the families were interconnected will help me to find a lead and break thru my Cook brickwall.  I've been using a spreadsheet to pull together my notes and information on this community so that I had somewhere to quickly look for notes on the families if they showed up in any other parts of my research. I'm publishing this to my blog in the hopes of finding other researchers interested in the area and time period that the information here might help.  This portion contains families who were living in or taxed in District 25 of Williamson Co TN during the years 1836-1840 whose surnames begin with R-S.  When possible I've noted connections in neighboring districts.  Simply put, there is a lot of overlap of families between Williamson Co TN Dist 25,  the Versailles and Eagleville area of Rutherford Co TN and Bedford Co TN Dist. 10(Rover). Also please note that anyone listed as NOT enumerated in District 25 should probably read not listed as Head of Household in Williamson Co. TN District 25.  They may be within another household OR they may not be enumerated at all within the district for a number of reasons.

I believe the other William Putman was the son of Amos Putman.  Amos William went on to Weakley and Henry Co TN and others of that line to Missouri.

[These Jacksons are Francis M Jackson and his descendants. Francis was the son of
Thomas and Mary Jackson. He was from Amelia Co Virginia. He married Elizabeth
W. Childress. Their children were born in VA except for Francis & David who were
born in Rockingham Co NC. Dick Poplin wrote an article about them which is in the
Rover Vol 2 Book on p 234]

PA. They moved south thru VA, NC and eventually Union Co SC before arriving in Williamson Co TN.
They left the Quaker religion and were active as Primitive Baptist (Padgett Creek SC). There are
connections between the Lambs and the Landrum thru their church, intermarriage and both came to TN
from Union Co SC Specifically those descendants of David Lamb and Esther Landrum]

He was also among those who made purchases at the Estate Sale of Joseph S Cook.
He married Martha Pope daughter of Charles Pope & Elizabeth Smith Pope.  Some
researchers have her as a 1st wife but she may have been the only wife.  The 1850 census
for them is a mess. She couldn't have died by 1851 as some claim as the youngest son's
death certificate said his Mom was a Pope. I'm thinking it is more than likely that Martha E's 
middle name was Emily. At any rate more research is needed and hopefully this will help.

Williamson Co. TN--Dist 25(1836-1840)--D-H

Over the past few years I've been studying Williamson Co TN Dist. 25 in hopes that knowing how the families were interconnected will help me to find a lead and break thru my Cook brickwall.  I've been using a spreadsheet to pull together my notes and information on this community so that I had somewhere to quickly look for notes on the families if they showed up in any other parts of my research. I'm publishing this to my blog in the hopes of finding other researchers interested in the area and time period that the information here might help.  This portion contains families who were living in or taxed in District 25 of Williamson Co TN during the years 1836-1840 whose surnames begin with D-H.  When possible I've noted connections in neighboring districts.  Simply put, there is a lot of overlap of families between Williamson Co TN Dist. 25,  the Versailles and Eagleville area of Rutherford Co TN and Bedford Co TN Dist. 10(Rover). Also please note that anyone listed as NOT enumerated in District 25 should probably read not listed as Head of Household in Williamson Co. TN District 25.  They may be within another household OR they may not be enumerated at all within the district for a number of reasons.

Davis--Goodwin Davis is on Dist. 25 Tax list for 1838 but was listed on the Dist. 10 Rutherford Co Tax list for 1837.   There is a Goodwin Davis(b. NC) enumerated in 1860 in Bedford Co Dist. 18 with a rather large family.  That Goodwin Davis' wife was a Henrietta Davis(maiden name unknown) Additionally Mrs. H. Davis(1840 Census-Williamson Co TN Dist 25)

Dillard--James(Dist. 25 Tax List:  1836) Could he be the one buried in Beechgrove(Coffee Co) d. 1839

Eggleston--Edward C(Dist. 25 Tax List 1836, 1837, 1838, 1839) John W(Tax List 1838, 1839) I believe these Egglestons are connected to those in May Community of Rutherford Co TN in the 1850  There are some which are in Moore & Franklin Co later on which I believe are also from this family.

Fagin-- John(Dist. 25 Tax List:  1839) I think this is likely John S Fagan who married Mary Elizabeth Smith.  They were the parents of Thomas Henry Fagan and grandparents of Urban B Fagan & John Walter Fagan, Maggie T Fagan & Richard Owen Fagan.

Fear--William(Dist. 25 Tax List:  1838) There is a Wm Fears on 1820 Rutherford Co TN Census Could be connected.

Ford/Foard--William(Dist. 25 Tax List:  1839) Enumerated in Dist. 25 in 1840.  There is a Wm Ford who marries Isabella Hill in 1843 Williamson Co TN

Gillespie--James D (Dist. 25 Tax List 1836, 1837, 1838, 1839 and enumerated there on the 1840 Census) He was the maternal uncle of Susan Carson(2nd wife of James Cook-son of Wm Clifford Cook & Elizabeth Putman) 

Haley--Carrol B Haley(Dist. 25 Tax list for 1838 & 1839.Enumerated there in 1840.)  His father Barnabas is on Bedford Co TN Dist. 10 Tax list for the year 1837.  Barnabas was involved in the Williams/Putman & Anglin case.  Carroll married Catherine Lamb. The wife of Barnabas(Carroll's mother) was Nancy Coursey and the Coursey family was also involved in the aforementioned court case.

Hall--Anderson (Dist. 25 Tax List:  1837, 1838 & 1839) He along with John Landrum(b-i-l) are Executors of John Hall Sr. will.

Halstead/Holstead--Benj. & John(Dist. 25 Tax List: 1837) Miles(Dist. 25 Tax List: 1838)  Joseph (Tax List: 1838 & Enumerated in 1840) Susan Halstead is on Tax List of 1839 and is likely the Mrs. Holstead enumerated on the 1840 Census of Williamson Co TN Dist. 25. 

Hargrove--William Hargrove is enumerated in Dist. 25 in 1840. Likely kin to Hezekiah  and Leroy Hargrove/Hardgrove who were in Rutherford Co TN 1810

Haynes--Elizabeth Haynes is enumerated in Dist. 25 in 1840. She is living alone and in the 60-under 70 age range.  Near Cannon, Pope, Cole and Lambs.

Height/Hight--Robert A Hight(Dist. 25 Tax List:  1839) John J Hight on 1838 Bedford Co TN Tax List  There are Heights with given names Robert and John in the 1820 Census of Statesville Wilson Co TN along with Patterson, Harris, Cook families.  They descend from John Hight and Eleanor Nichols.  Some of these Hights have Mercer Co KY connections as do the Harris and Cook family

Hendrix--Elisha W & Thomas(Dist. 25 Tax List:  1836, 1837, 1838, 1839 & 1840 Census) Elisha Hendrix' property is mentioned in the deeds of Jabel's land when Wm Putman deeds his and Hiram's lots to Nancy Putman.  Adam Hendrix (Dist.25 Tax List for 1836 &1837).  Mary Hendricks(Dist. 25 Tax List for 1838, 1839 & 1840 Census) She may be the widow of Adam who drops from the list. Newberry SC ancestry.  See Deed Book for the Putman deeds.

Hill--William Hill(Dist. 25 Tax List:  1836, 1837, 1838, 1839 & 1840 Census) Is this the father of J Benjamin Hill?  If so this family is from Granville Co NC. and William Hill was enumerated there in the 1800 US Federal Census(see History of Versailles).  Wm Hill's property line is also mentioned along with Elisha Hendrix' property line in the deeds that Wm Putman sells or transfers to Nancy Putman that were part of his and Hiram's land inheritance from their father's estate. see deed book

Hogan--John Hogan(Dist. 25 Tax List:  1838, 1839 & 1840 Census)Lived in Versailles : Married to Lucinda Wood in 1819 b. about 1798. Died in Williamson Co  14 Apr 1856 War of 1812 Pension

Holt--David, Edward & Thomas(Dist. 25 Tax List:  1836) There is a Thomas Holt in 1840 Williamson Co TN but the district is a  bit confusing and appears to say "Nineteen First Civil District"

Hood--John Hood(Dist. 25 Tax List:  1836) May be connected to the Rutherford Co TN John Hood who married Celia Fuqua in Davidson Co TN and who is enumerated in Rutherford Co in 1850.  Check Bradley Creek Baptist where they were members.

Hopkins--George(Dist. 25 Tax List: 1836) married Elizabeth Crick(dau of John Wm Crick) which made him a brother-in-law to several of the Putmans.

Hunt--Robert A (Dist. 25 Tax List: 1838 & 1840 Census) Near Pope, Webb, Crick families in 1840

Williamson County TN School Census Records

Williamson Co TN records of the school census for that county are online but not yet indexed at FamilySearch.org.  I was extremely glad to find them as I'm always looking for more clues for my 2nd Great Grandfather William Clifford Cook and I knew he was on the 1838 tax list in District 25 of Williamson Co TN.

The School Census section of that film begins on image 934 of 2937 

The School census start in 1838 with reports from each of the districts which list the name of the adult and how many children from their household are in the age range for attending schools.  The range changes a bit over the first few years.  In the beginning it was children over 6 and under 16 but by 1842 it appears to change to above 6 and under 21.  The Districts weren't always in order so I had to read over them to seek out the 25th District which I wanted to check.

A check of the years 1838-1849 gives me the following results

My William C Cook is only on the 1841 School Census listed as having one child over 6 and under 16 as of 30th of June of that year.  That one child in the age range for school is Wm C Cook's oldest daughter Minerva Cook.  This may be her first year of school.  Wm C Cook was on the Bedford Co TN Dist 10 tax lists for 1836 & 1837.  He wasn't listed in Bedford Co TN on the 1838 list but rather in Williamson Co TN as I previously stated.

By 1844, there is no longer a listing for District 25 due to county boundary changes which seem to already be a bit "hazy" to begin with.  Years 1850-1853 do not appear with the records but they do resume in 1854.
